From Investigations to Transaction Monitoring: the rationale for moving analytics forward in time

Traditional investigative, auditing, and monitoring processes often select transactions for review months or years after a transaction has taken place, failing to meet the expectations of enforcement agencies, such as the U.S. Department of Justice, to detect and remediate wrongdoing immediately and before issues become systemic. Traditional investigative, auditing, and monitoring efforts are also often manual and control-focused and tend to generate too many items to review. Furthermore, as a general matter, investigations are time-consuming and costly, and it is almost always wiser to identify and mitigate risky transactions before they become problems. Although transaction monitoring can empower companies to risk score organizational transactions for multiple risks and pivot from a sample-based approach to real-time continuous monitoring, it is often difficult to know just how to get started.

In this webinar, we will cover how to get started, including educating stakeholders and making the business case for implementing a continuous monitoring tool, as well as best practices in evaluation and implementation.

Jennifer H. Saperstein, co-chair of the Anti-Corruption Practice Group, advises clients on compliance and institutional culture issues, including compliance questions arising under the Foreign Corrupt Practices Act (“FCPA”) and other anti-corruption laws. An experienced compliance counselor named a Compliance Rising Star by Law360, Jennifer frequently conducts risk assessments and compliance program assessments, and has developed anti-corruption compliance programs for clients across a wide range of industries. She also leads cross-cutting compliance projects to help companies build and improve their compliance programs across areas of regulatory expertise, bringing together teams of regulatory experts to provide integrated advice. As part of her compliance practice, Jennifer regularly assists companies with anti-corruption due diligence and compliance integration in connection with acquisitions, asset purchases, joint ventures, and other investment transactions.

Pete is an internationally recognized anti-corruption specialist, an experienced international forensic accounting investigator, and an investigative practice leader. Most recently, Pete served as an Associate Managing Director in the anti-bribery/corruption (“ABC”) and Fraud group at Exiger. While at Exiger, Pete won and led a variety of engagements throughout the pandemic period, including litigation-related investigative research, corruption risk assessments/remediation, and fraud/corruption investigations for global clients. Pete also started the Thought Leadership Forum at Exiger, working closely with the Sales & Marketing team. Prior to joining Exiger full-time in January 2020, Pete was a contractor supporting Exiger’s contracts with the US Department of Justice FCPA and Securities Fraud Units. Before joining Exiger, he led the PwC Malaysia Investigations practice, which grew significantly in both headcount and revenue during his three-year secondment period, and was PwC’s Southeast Asia regional lead for Anti-Bribery & Corruption.

Mihnea’s expertise spans multiple industries, including life sciences, technology, hospitality, and industrial products. Mihnea’s key experience includes a wide variety of anti-bribery-related assignments, ranging from compliance monitorships, audits, investigations, and risk assessments through full-scope design and enhancement projects where clients have needed support at every stage across the program upgrade. Mihnea has also assisted Counsel in enforcement matters brought by the US Department of Justice and Securities and Exchange Commission. He also worked on executing a multi-billion dollar class action settlement, one of the largest of its kind in US history.  Mihnea is a Fellow of the Association of Chartered Certified Accountants (FCCA), a Certified Fraud Examiner (CFE), and a Certified Anti-Money Laundering Specialist (CAMS). He holds a Bachelor’s in International Business from the Bucharest University of Economic Studies, Romania.
